Arrears, delays and high cost of litigation have become a source of major concern for the litigants, the Government and the Judiciary, all over the world, more particularly in our country. The delay in justice dispensation, particularly in commercial and family disputes, causes great hardship and financial loss to the parties. In order to reduce delays in resolution of disputes, the Governments and the Judiciary are encouraging out-of-court settlements by ADR methods such as arbitration, conciliation, mediation etc. Suitable laws have been enacted for promoting ADR such as the Family Courts Act, 1984, Legal Services Authority Act, 1987, Arbitration and Conciliation Act, 1996, thelatest being insertion of Section 89 in CPC which provides for ADR methods even in suit field cases.
ADR methods can be used to resolve disputes arising out of matters relating to commerce, trade and industry, both domestic as well as international, building and onstruction, Joint ventures, Government, insurance, accidents, partnerships, companies, insolvency, service, property, matrimony etc. There is now a great demand for ADR Practitioners in India, particularly in view of implementation of Section 89 of CPC throughout India and with the advent of foreign business ventures in India.
