Arrears, delays and high cost of litigation have become a source of major concern for the litigants, the Government and the Judiciary, all over the world, more particularly in our country. The delay in justice dispensation, particularly in commercial and family disputes, causes great hardship and financial loss to the parties. In order to reduce delays in resolution of disputes, the Governments and the Judiciary are encouraging out-of-court settlements by ADR methods such as arbitration, concilation, mediation etc. Suitable laws have been enhanced for promoting ADR such the Family Courts Act, 1984, Legal Services Authority Act, 1987, Arbitration and Concilation Act, 1996, the latest being insertion of Section 89 in CPC which provides for ADR methods even in suit filed cases.
The ADR methods save time, money and enable the parties to have more control over the processes and its outcome, while preserving the relationships. The arbitral award or the settlement reached between the parties has the same status as a court decree.
ADR methods can be used to resolve disputes arising out of matters relating to commerce, trade and industry, both domestic as well as international, buildig and construction, joint ventures, Government, insurance, accidents, partnerships, companies, insolvency, service, property, matrimony etc.
The ICADR in collaboration with NALSAR University of Law has been conducting for the last 6 years Post Graduate Diploma courses in the law, skills and techniques of resolving disputes by ADR methods, which include theory and practical cases. So farnearly 500 persons have been trained in ADR methods by us.
